Welcome to Fathom. These Terms of Service ("Terms") govern your access to and use of the Fathom application, website, and related services (collectively, the "Service"), operated by Fathom.
By downloading, accessing, or using Fathom, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Subscriptions and Payments
Fathom is offered as a premium application. We provide a generous free trial so you can experience the app fully before purchasing.
- Billing: Following your trial, Fathom requires a subscription. Payment is charged to your Apple ID account at the confirmation of purchase.
- Auto-Renewal: Subscription automatically renews unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
- Management: You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
2. Intellectual Property Rights
Our Property:The design, structure, aesthetics, hand-drawn celestial doodles, ambient soundscapes, code, and overall "look and feel" of Fathom are the exclusive property of Fathom. You may not copy, reverse engineer, or distribute our intellectual property without written permission.
Your Property: The EPUB files and books you import into Fathom belong to you or their respective copyright holders. We do not claim any ownership over your library. You are solely responsible for ensuring you have the legal right to possess and read the files you upload to your device.
3. User Conduct
You agree not to:
- Use the Service for any illegal or unauthorized purpose.
- Attempt to reverse engineer, decompile, or extract the source code of the Fathom app.
- Distribute pirated or copyrighted material unlawfully using the Service.
We reserve the right to terminate or suspend access to our Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason.
4. Disclaimers and Limitations of Liability
Fathom is provided on an "AS IS" and "AS AVAILABLE" basis. We strive to provide a beautiful, seamless reading experience, but we do not warrant that the Service will be uninterrupted, error-free, or entirely secure.
To the maximum extent permitted by applicable law, Fathom shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
5. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved exclusively in the jurisdiction of the competent courts in India.
6. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
